The Madrid Protocol for International Trademark Registration

The Madrid System is the primary international system for facilitating the registration of trademarks in multiple jurisdictions around the world. Its legal basis is the multilateral treaty named the Madrid Agreement Concerning the International Registration of Marks of 1891, as well as the protocol relating to the Madrid Agreement, the Madrid Protocol (1989). The Madrid Agreement and Madrid Protocol were adopted at diplomatic conferences held in Madrid, Spain. As of September 2012, 86 countries have joined as participating with the Madrid Protocol. These countries are called "Contracting Parties” and the filings are being handled by the World Intellectual Property Organization which promotes itself as a balanced and effective international intellectual property system. Surprisingly, Canada has yet to join the Madrid Protocol. The Madrid Protocol went into effect in the United States on November 2, 2003. As of that date, U.S. trademark owners became able to submit an international application to the United States Patent and Trademark Office to forward to the International Bureau in Geneva, Switzerland. Similarly, as of that date, foreign trademark owners could seek extension of protection of an international registration of their mark in the United States.
