In Re Bilski: Update

On June 1, 2009 the Supreme Court decided to grant certiorari in the case of In Re Bilski (now Bilski v. Doll). Last fall the Federal Circuit ruled that the Bilski method patents would not be allowed because they did not pass the machine-or-transformation test (an invention must be implemented with a particular machine or transform an article from one thing or state to another). In light of the ruling the USPTO has changed the way it reviews method patents. This caused shock waves through the patent world as many method patents and patent applications were affected. Many in the method patent world are hoping that the Federal Circuit ruling is overturned by the Supreme Court, as they often overturn cases they chose to accept. The patent world will be watching with interest as the Supreme Court makes its decision.
